Comment: Islamic Law has the Quran,the Sunna( sayings and actions of the Holy Prophet),Ijma(consensus of the Muslim Community lead by the jurists on juridical matters)and Qiyas ( analogical deductions) as the bases for all jurisprudential exercises. These four are the basic principles as agreed by all the major schhools of Law. However, the Maliki school of Law has added another principle as an important pillar in Islamic Jurisprudence, and that is Amal. Many people are generally unaware of the history, process and significance of this concept. Dutton in this wonderful book has brilliantly highlighted the crucial role of Amal not only in the Maliki school, but in Islamic law itself. Furthermore, he brought to the fore the important difference between the concepts of Sunna and hadith in the light of Amal ahl al-Madina. (ie the practice of the people of Madina as obtained in the early history of Islam).He also showed how the jurists resolved this delicate dichotomy during the early phase in the development of Islamic Jurisprudence and how such efforts actually led to the rise of the various schools of Islamic Jurisprudence. This book is therefore a necessary reading to all students and scholars of Law, hadith and history. The bibliography/references provided are very useful and can serve as useful guide to further readings especially on the Maliki School of Law.
